The SC rules do not specify that a SC must be confirmed by the Senate because he/they are not principals, they are instead 'inferior officers' so in a different category. Multiple courts as well as SCOTUS have agreed that they are not principals.
Her role as a judge in this instance was to apply precedent to the case before her, not to remodel it for her own purpose.
Her decision to dismiss will not stand. If it did that would mean that previous SC's cases would also fall. Think back to the 25 years of precedent.
Also worth noting that in public Trump repeatedly charges that the SC has been under Biden's control yet in the defense's court papers and with this ruling the exact opposite is set forth, that the SC is TOO independent.

Maybe get a prosecutor who’s actually been confirmed by the Senate like our constitution requires and not use a hack bulldog knucklehead who gets overturned by SCOTUS 9-0!
